Article 1: Scope and modification of the general terms and conditions of sale
These general terms and conditions of sale apply to all orders placed on the www.uwl-surfshop.com website, by telephone or at the UWL workshop. UWL reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day the order is placed will apply to each order.
Article 2:Product availability
Our product offers are subject to availability. On receipt of your order, we will check the availability of the product(s) ordered. In the event of unavailability, we undertake, within 30 days of placing the order, either to deliver the product ordered or to offer you a similar product at a similar price, or to reimburse you. If one of the products in your order is out of stock, we will ship the rest of your order with an information message.
Article 3:Price
Prices are given in euros and include VAT, but exclude shipping costs. The user is responsible for payment of shipping costs, unless he/she benefits from a special offer exempting him/her from these costs. UWL reserves the right to modify its prices at any time, in particular in the event of an increase in charges or in the rate of VAT, or in the event of an obvious error, but undertakes to apply the current prices indicated at the time of your order, subject to availability on that date.
Article 4:Payment methods and security
You can pay by :
> by credit card: no banking information concerning you is transmitted via the uwl-surfshop site. Payment by credit card is perfectly secure; your order will be recorded and validated as soon as payment is accepted by our banking department. Your credit card details are encrypted using SSL 128 (Secure Socket Layer) and are never transmitted unencrypted over the network. Payment is made directly to the Crédit Agricole e-transaction bank. UWL has no access to this data, and does not store it on its servers. For this reason, you will be asked to provide this information for each new transaction on our site.
> by bank transfer: When you receive your order confirmation, you will be provided with a bank account number. Your order will be registered and validated upon receipt of payment.
> by Paypal: you must have a Paypal account to use this payment method. http://www.paypal.com/fr/
> by cheque: send us a cheque payable to UWL surfshop to the following address: UWL SURFSHOP - Commande internet ZAC des Fourneaux, 3 rue Albert Denis 17690 ANGOULINS FRANCE UWL cannot guarantee product availability for orders paid by cheque. Please attach a printout of the order confirmation you received by e-mail. Your order will be registered and validated upon receipt of payment.
Retention of title :
Products remain the property of UWL until full payment of the order. However, from the moment of delivery, the risks of the goods delivered are transferred to the customer.
Payment default :
UWL reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid in full or in part for a previous order or with whom a payment dispute is being administered.
Anti-fraud controls :
All orders validated on our site are checked. The purpose of these checks is to protect UWL from fraudulent practices. As part of these procedures, our services may ask you to provide all the documents required to release your order: proof of address and debit in your name, etc... These requests are made by e-mail.
Article 5: Terms of delivery
UWL cannot be held responsible for the consequences of late delivery by the Carrier. UWL may be exempted from all liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer or to the unforeseeable and insurmountable act of a third party to the contract.
Products purchased on the UWL website can be delivered to the following countries: Metropolitan France, Corsica, Monaco. For other destinations, UWL will make a customized shipping proposal.
For tracking reasons, we are unable to deliver orders to military bases, hospitals and vacation centers.
> Delivery times: Delivery may vary from 1 to 3 working days for metropolitan France, Corsica and Monaco, subject to product availability (in accordance with article 2). Public holidays do not count as working days.
Delivery may vary from 7 to 30 working days for foreign countries, subject to stock availability (in accordance with article 2). This is an average delivery time, depending on destination, shipping method and item availability.
> Delivery methods: The product ordered is delivered by an express carrier, depending on the nature of the product ordered and to the address shown on the order form.
> Delivery: You must check the conformity of the goods delivered at the time of delivery and before signing the delivery note (CARRIER). You must indicate on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomaly concerning the delivery (damaged product, etc.). This verification is considered to have been carried out once the purchaser, or a person authorized by the purchaser, has signed the delivery note.
You must also confirm these reservations to the carrier by registered mail no later than three working days following receipt of the item(s) and send a copy of this letter to "UWL SURFSHOP- Service Client - 3 rue Albert Denis, ZAC des Fourneaux - 17690 ANGOULINS France". If products need to be returned, they must be returned within thirty working days of delivery. Any claim made outside this period will not be accepted. Returns will only be accepted for products in their original condition (packaging, accessories, instructions, etc.).
If, at the time of delivery, the original packaging is damaged, torn or open, you must check the condition of the items. If they have been damaged, you must refuse the parcel and note a reservation on the delivery note (parcel refused because opened or damaged). We remind you that if you refuse the parcel, it will be returned directly to us, with no transport costs at your charge.
Article 6: Responsibilities
UWL shall not be held liable for non-performance of the contract due to force majeure, act of God, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire.
The choice and purchase of a product are the sole responsibility of the customer. The total or partial impossibility of using the products, notably due to equipment incompatibility, cannot give rise to any compensation, reimbursement or liability on the part of UWL.
In the event of non-delivery of an order or part of an order, you have a maximum of one year (from the date the order was placed) in which to make a complaint. After this period, we will not accept any claims.
Article 7: Right of withdrawal
> Withdrawal period: In accordance with article L.121-20 of the French Consumer Code, the consumer has a period of seven days to exercise his or her right of withdrawal without having to justify his or her reasons or pay any penalties, with the exception, where applicable, of return costs. The consumer may waive this period if he/she is unable to travel and at the same time requires an immediate service necessary to his/her living conditions.
The period referred to in the previous paragraph runs from receipt for goods or acceptance of the offer for services. Where the information specified in article L. 121-19 has not been provided, the period for exercising the right of withdrawal is extended to three months. However, when this information is provided within three months of receipt of the goods or acceptance of the offer, the thirty-day period referred to in the first paragraph begins to run.
If the seven-day period expires on a Saturday, Sunday or public holiday, it will be extended to the next working day. The product must be returned in good condition, with all accessories (e.g. manuals, assembly tools, warranties, etc.), in its original, unused packaging. The right of return cannot be exercised for items that can be copied (DVD, Video, etc.) unless they are returned to us on time and in their original packaging.
> ATTENTION: No right of return can be exercised for personalized or made-to-measure items. Any cancellation of an order can only be taken into consideration if it is received in writing before the start of the work. Any administrative and technical costs incurred are entirely at the customer's expense. The minimum amount of these costs, depending on the progress of the order, is €25 excluding VAT as of 01/01/2015.
> Return procedure : You are responsible for return shipping costs in the case of a retraction. UWL will cover the cost of returning a product that does not conform to the order. All you have to do is contact the UWL store and we will send you postage at our expense. This right of return can only be accepted for complete products, in their original condition (packaging, accessories, instructions, etc.) with a copy of the purchase invoice. Items returned incomplete, damaged or soiled by the customer will not be accepted for return or exchange.
We undertake to provide you with an exchange, credit note or refund within a maximum of 15 days of receipt of the products by us. No COD shipments will be accepted.
Article 8: Warranties and after-sales service
All our products come with a one-year manufacturer's warranty on parts and labor. In the event of a breakdown during the initial warranty period, repairs will be carried out free of charge by the national network of manufacturer-approved technical centers, stations or agencies. Special case of skateboards, surfboards, kitesurf boards, wakeboards, bodyboards and mountainboards: contact us for all warranty and after-sales service requests, which depend on the conditions of use of the equipment. In order to benefit from the product warranty, it is imperative to keep the product purchase invoice or to have it in the customer fi le. We remind you that you are also covered by the legal warranty for hidden defects under articles 1640 et seq. of the French Civil Code.
Article 9: Information technology and civil liberties
At any time, "you have the right to access, modify, rectify and delete data concerning you (art 34 of the French Data Protection Act of January 6, 1978). UWL will not divulge your personal details to any third party. In accordance with the law, the UWL website database is registered with the CNIL under number 1607501.
Article 10: Applicable law and jurisdiction
All relations arising from the connection to and/or use of this site are subject to French law. The competent court in the event of litigation will be the court of La Rochelle.
